MakPrinting.com Terms and Conditions

By placing an order with MakPrinting.com (the “Website”) or by otherwise accessing the Website, users hereby agree to the following terms and conditions (the "Terms & Conditions"):

User Accounts

As a condition to access certain services being offered at the Website, users may be required to register themselves with us and in doing so, must provide current, accurate, and true account details at all times. Users must agree to promptly update their membership details to keep it accurate, current, and complete.

Account Security: Users are solely liable for securing the privacy of their password and may not disclose it to any other person. Should an unauthorized individual gains access to the password-protected area of the site, consequently, your omissions or acts; you agree that you shall be responsible for any such unauthorized activity..

We explicitly reserve the right, at our sole discretion, to terminate a user’s access or their account to any or all parts of the Website due to any act that would lead to the violation of these Terms & Conditions.

User Conduct

You are fully responsible for the contact of any materials and content you submit or post via the Website. You agree and assure that you will not distribute, transmit, post, upload or otherwise publish via the Website any content which: (i) are profane, threatening, harassing, or unlawful; (ii) inhibit or limit other users from enjoying or accessing the Website; (iii) facilitate, encourage, or constitute conduct that would give rise to any civil liability or criminal offense; (iv) contains a virus or other such destructive malicious codes, or (v) contains any misleading or false information or statements of fact or origin.

You may only access this Website to make legal requests to purchase the services or products being offered, and shall not use this Website to make any ill-intending, fraudulent, false, or speculative Requests. You may not use any automated means or robots to access the Website, unless permitted by Mak Printing Inc.

It is a violation by law to place a Request in a false name or with an invalid credit card. Users must be aware that, even if they do not provide us with their real name, their Web browser transmits an exclusive Internet address that can be accessed by the law enforcement to identify them. Duplicitous users perhaps be impeached to the fullest extent of the law.

You may print in hard-copy and electronically copy segments of this Website for the sole purpose of accessing the Website as a printing or shopping resource. Any other use of content or materials on this Website, including reproduction for a purpose other than the ones mentioned above, without prior written agreement, is prohibited.

Moreover to the prior and in consideration of being permitted to access the Website, Users must agree that the following actions shall lead to content breach of the Terms & Conditions:

  • Collecting details about the Users or Website without our explicit written approval:

  • Changing, injecting, truncating, filtering, mirroring, rendering (or re-rendering), framing or modifying information or content of the Website, without our written consent;

  • Using any algorithm or methodology, program, automatic device, Internet agent, click spam, macro programs, spider, crawl, robot, index, page-scrape, or deep-link which does similar or same things, to access, use, obtain information, copy, input information, generate clicks or impressions, generate searches, store information, monitor the Site or any portion thereof;

Except to the point where we expressly provide otherwise, nothing made accessible to Users through the Website perhaps be considered to confer any ownership right in or license or content published or otherwise made accessible via the Website or its services, whether by implication, estoppel, or otherwise. All privileges not granted to you in the Terms & Conditions remain earmarked by us.

Corporate Identification and Trademarks

MakPrinting.com and all other related marks that appear on the Website are trademarks of MakPrinting in the U.S.A and other jurisdictions. You may not copy, use, post, reproduce, upload, distribute, transmit, republish, or alter the Trademarks in any way, including in publicity or advertising pertaining to content distribution on the Website, without MakPrinting’s prior consent. The use of trademark on any other network or website is prohibited. MakPrinting expressly proscribes the use of Trademarks as a ‘Hot’ link to, or on, other websites unless an establishment has been made in regards to the publishing of the links by MakPrinting in writing.

Copyright Notices for Content on the Website

While you believe in good faith that content appearing on the Website infringes your copyrights, you may send us a notice right away that the content be removed, or get an access to get it blocked. IN NO EVENT SHALL THE COVERED PARTIES’ FULL LIABILITY TO YOU FOR ALL LOSSES, DAMAGES AND CAUSE OF ACTION (WHETHER IN TORT OR CONTRACT, INCLUDING BUT NOT RESTRICTED TO NEGLIGENCE) ARISING FROM THIS CONVENTION OR YOUR USE OF THE WEBSITE SURPASS THE AMOUNT PAID BY YOU TO MAKPRINTING FOR THE SERVICES, PRODUCTS, REQUEST RELATED TO THE CLAIM.

User Comments, Feedback and Other Submissions

You agree and acknowledge that any suggestions, feedback, ideas and comments disclosed, offered, or submitted to a Covered Party in connection with your use of the Website shall remain and become the exclusive Mak Printing Inc property. No Covered party, under any obligation maintains the comments in confidence, or to pay you any compensation for the comments submitted on the Website, or to respond to the comments. You agree to be fully responsible for the content of the comments you make on the Website.

The comments perhaps be used by a Covered Party for any purpose globally, without obtaining your consent; you abandon all rights to such Comments.

Termination

Mak Printing Inc has the privilege to terminate a user’s account or restrict their access to the Site and its services at any time. Mak Printing Inc termination may consist of restricted access to the services, deletion of account and password, deletion of all related files and information, deletion of content related to the account, and other steps that prevent the user to further access the Website and its services. In case you are not satisfied with the Website, your exclusive and sole remedy is to immediately discontinue the use of the Website.

Privacy

You validate that you have understood, read and agree to the MakPrinting.com Privacy Policy, the terms of which have been incorporated herein, and agree to the fact that the terms are satisfactory and reasonable to you. You agree to the use of your personal information by Mak Printing Inc, the third-party providers, its distributors as per the terms and for the purposes that have been set forth in the MakPrinting.com Privacy Policy. If you do not reside in the U.S.A, kindly note that the personal details you submit onto the site will be transferred to the U.S. and processed by MakPrinting in order for you to access the Website and its services, or for any other purposes.

Amendments to Terms & Conditions

Mak Printing Inc reserves the rights, at their sole discretion, at any convenience or time, to modify, change, or alter the Terms and Conditions at any time. Users must agree that we can alter the Terms and Conditions and such changes shall be effective immediately once posted. We do try to update the ‘Last Updated’ date at the top with any such changes. Users must review the Terms and Conditions periodically to be aware of the modifications. Use or continued access to the Site following these postings shall be deemed as a conclusive evidence of your acceptance and review of the altered Terms and Conditions except and to an extent outlawed by federal or applicable state law.

Changes Occurring To the Website

We do reserve the privileges, for any reason, in our sole discretion, to modify, terminate, remove or suspend any aspect of the Website consisting but not limited to services, content, features, prices, or hours of availability. We may impose restrictions on specific features of the Website or limit User access to any part, or even all of it without penalty or prior notice. Users must agree that Mak Printing Inc will not be held responsible to users or third-parties for any such modification, limitation, suspension, change or discontinuance of the Website.

Entire Agreement

These Terms & Conditions, in line with the Privacy Policy and the terms and conditions incorporated here or have been referred to, comprise of the entire agreement between the User and each Covered Party related to the subject matter hereof, and surpass any prior agreements or understandings (oral or written) related to the subject matter, and perhaps not be modified or amended without doing much in writing or by making such modifications/amendments available on the Website.

Governing Law & Exclusive Venue for Disputes

Users and Mak Printing Inc agree to the fact that the Laws of the State of California, USA govern these Terms & Conditions and your access to the Website, without regard to such state’s conflicts of laws principles. Users agree to the particular venue and jurisdiction of the state along with federal courts located in the County of Los Angeles in the State of California for all disputes relating to, or arising out of, the Terms & Conditions and access to the Website or its services.

Notice is served for Users residing in California only. This notice is viable for users accessing the Website from the State of California. Equitable Relief

You agree that a breach of these Terms and Conditions will lead to irreparable loss to us for which financial damages would not be appreciated and we shall be entitled to equitable relief along with any remedies we may have hereunder or at law without a bond, proof of damages or other security.

Notices under these Terms & Conditions

Except as it has been clearly mentioned otherwise, any notices shall be sent via email to Mak Printing Inc at [email protected] or to you at the email ID provided to you by Mak Printing Inc. Notices shall be considered given 24-hours after the email has been sent, unless the sending party has been notified that the provided email address is invalid.

Payment

All amounts and prices shown on the Website are in the U.S. Dollars (USD), unless stated otherwise. All prices mentioned on the Website and stated herein are subject to change at any time and for any reason without any prior notice with the payment amounts along with other related terms subjected to additional agreements between Mak Printing Inc and the User.

If Users submits an order on the Site to purchase design services, mailing services, printing products or other services, the User completely agrees that all taxes, charges and handling/shipping fees and postage will be automatically charges to the Credit Card or will be paid by the User via an approved payment method.

Production of all ordered items is subjected to the terms highlighted below in the ‘Printing Turnaround Time’ section and will not commence until the order is fully paid, including the handling and shipping charges, if application expect Mak Printing Inc has explicitly agreed to excusive delayed payment terms (for instance Net 30) with the User before placing the order. Users who collaborate with Mak Printing Inc to have delayed payments must provide payment as per the agreed terms of their applicable payment contract(s).

Once the User approves the print files as mentioned in the ‘Printing Turnaround Time’ section, the order will move to ‘Production’ and no additional charges will be permitted to the print files, job traits, or printing turnaround time. As the order is in ‘Production’, the complete amount of order along with the shipping/handling charges and applicable taxes shall be deemed totally paid and non-refundable, except as mentioned for in the Return & Refund Policy. List Purchase, Additional Service Fees, and USPS Postal Costs are non-refundable. Except as it has been mentioned in the Return & Refund Policy, any payment that has been received from the User shall be considered fully paid to Mak Printing Inc and is non-refundable at the rate of twenty percent of each calendar month that passes after a user has initially submitted even in the event where the printing job never reaches the production or shipment phase due to no mistake of Mak Printing Inc (for instance, the user fails to approve the print proofs, User fails to provide relevant information, User fails to cancel the order prior to reaching in the ‘Production’ Phase, etc.)

Return & Refund Policy

At MakPrinting.com, we provide our Users with the finest quality printing services. If you are not completely satisfied with your products for any reason, do get in touch with our customer services department. All of our policies are subjected to modifications with prior intimation. Defective product reprints and refunds shall not surpass the amount paid by the user or $1,000.00, whichever is less. Determining the defective product is completely at the discretion of MakPrinting. In most events, Users are requested to share the digital copies documenting the defective piece or ship the defected article to the customer service. Free expedited reprint or any orders that are lost in the transit is limited to orders less than or equal to $350..

Proofs

At the user request, once we receive your printable files, an online proof will be made for your review. The basic process time varies on our current workload. Tasks with proofing requests are not sent to the press without the Customer’s approval unless the approval is clearly waived. If you have not proofed your content, we print it as it is and hence do not take any responsibility for final accuracy or quality of the product. It is the customer’s responsibility to log into their account and check on the proofs.

A proof done online by no means exhibit true color reproduction of the final product but is the last call for user to check the design, crops, bleeds and final text. Online proofs do not indicate transparency and over print concerns, nor color variations from RGB or Pantone to CMYK.

The proof should be considered as independent from the actual submitted document and comprehensively reviewed prior to being approved. The proofed version should be checked against the original file for possible errors in copy, layout, spacing, image placement or punctuation. User is entirely responsible for all that is contained in the proofed version of file.

If requested, MakPrinting.com offers hardcopy proofs which illustrate reasonable preference to the final output. Such proofs are highly recommended for color-critical art and the user must request them while a print order is made.

Cancellation

Any order will not be canceled once it is ‘In Production’. If the order is still in the proofing or preflight phase, it perhaps be canceled subject to the following charges, when applicable:

  • Orders that have been placed, paid for and then canceled before 5PM PST on the same day perhaps be refunded completely or reserved as Store Credit which will apply to future orders;

  • Orders that are below $100 do not subject to cancellation charges;

  • Orders varying from $100 to $500 will be charged 15% cancellation fee;

  • Orders that are $500 and above are subjected to a cancelation fee of 10% on the full order amount

Color Accuracy

MakPrinting.com ensures its best efforts to reproduce color from the provided print-ready files, but may not be able to match the color and density. Due to inherent limitations with the printing process, along with neighboring image ink requirements, the color reproduction accuracy is not guaranteed. When placing an order with MakPrinting.com, you understand and agree to this particular limitation. We do try our best to match the density of each color, but do not hold any responsibility for color variations that take place between the files submitted and the final output.

Under no conditions, we will reprint the files for color variations that not matched during the printing process. We do not take responsibility ink density or color matching on screen proofs that you have approved. Screen proofs predict design layout, text accuracy, image placement and proportion, but not density or color. Application of UV coating perhaps changes or affects the appearance of the output.

No Liability for Errors

We do not take any liability for errors that appear in the final product, as this could be due to the following reasons:

  • Files that are not created using our provided specifications

  • Grammatical, punctuation and spelling errors

  • Color variances from the conversion of RGB or Pantone colors to CMYK

  • Errors in User-selected options like quantity, size, paper and finishing

  • Low quality or low resolution images and graphics

  • Over printing issues

  • Damaged fonts

  • Corrupt or incorrect files uploaded

  • Cracking on folds

  • Inaccurate file orientation

  • Cutting variances

  • Damage to the products after they have been delivered

  • Undeliverable or incorrect shipping addresses

User is fully responsible for reviewing the documents and correcting issues, if any, prior to placing an order with us.

Artwork Files

Our prepress departments crosschecks all submitted artwork files prior to sending them to production, but you are still responsible for the accuracy of your artwork files; we encourage you to proofread all of your files accurately before they are being submitted to us. We do not take any responsibility for any issues as to the alignment or orientation of the pages of the artwork you have submitted to us. By submitting the files in connection with your access to the Website, you authorize that you have the right to use the image(s) in your artwork.

Under the MakPrinting.com Terms & Conditions, you agree NOT to upload any artwork comprise of the following material: improper, indecent, nudity, offensive or any material that could lead to criminal or civil liability under the applicable law; or any material that could infringe copyrights, rights of privacy, publicity, or other intellectual property rights without the permission of the owner(s) and the people who are shown in the material, if applicable.

Stock Images Terms

We allow users to access to professional stock images via Adobe integration. The licensing fee(s) for stock images(s) included in the artwork file will be added to your total during checkout. When you purchase the stock image(s) this way, you agree to keep to al application Adobe agreements. Any problems created as a result of using these images are subject to Adobe agreements; we do not hold any responsibility for any failures, issues, or mishaps that occur while you are using this service.

You can neither exchange nor return any stock image(s) that you have purchased as all sales are final.

Printing Turnaround Time

The printing turnaround period commences after we have received the ready-to-print files, along with proof approval, and full payment for the order. In case you have considered waiving off the proof approval, the printing turnaround period starts right after we have received the printable files and full payment of your order. For all orders that do not source digital files, or files that are not print-ready, the printing turnaround time starts right after we have received the print-ready files regardless of when the payment for the order was made.

Orders must be paid, with printable files received and proof approvals made by 5:00 P.M. PST (8:00 P.M. EST) for the printing turnaround time to commence the next business day. For instance, an order that has a two-day printing turnaround period that has been submitted at 3:00 P.M. PST (6:00 P.M. EST) and accepted by 5:00 P.M. PST (8:00 P.M. EST) on Tuesday will then be shipped by Thursday evening. If a proof has been approved on the Next Day Turnaround order by 5:00 P.M. PST (8:00 P.M. EST) on Tuesday, it will be shipped out to you by Wednesday.

Kindly note the production does not ship on the Weekends and Holidays. Therefore, these days are not included in the turnaround time.

Shipping

Unless you consider Mailing or Pickup services, you must select one of the shipping methods available on the Website. All shipping may be done via UPS, FedEx, or other freight carriers. We reserve the right to use the services of the most suitable carrier for the require transit period and destination. While picking a shipping method, please remember that the estimates shipping transit period is based on the number of business days in transit and does not include holidays, weekends or the day when the package is picked up by the shipping carrier. For instance, a product that is being shipping Two Day service and then picked up on Thursday would be delivered by Monday evening.

We do not take any responsibility for damages that take place during shipping.

Pickup orders can be put on hold for 30 days from the sent pickup date notification email. If the order does not get picked up from the facility within 30 days, it will be recycled.

We reserve right to revise the shipping options picked by the user and retain any concerning difference in charges between shipping options, where we deliver the product prior to the turnaround period picked by the user and in such case, there will be no opposing material effect on the target arrival date.

Target Arrival

The target arrival period is calculated by determining the printing turnaround time to the shipping transit period. Both the printing, as well as, shipping periods are based on business days alone and do not including holidays or weekends.

Sales Tax Policy

MakPrinting.com charges sales tax on orders shipped with in California. If you are tax exempted, you must share the tax exemption certificate. No sales tax is charged on any orders shipping out of California.
